Workers' Compensation Medicare Set-Aside (WCMSA)
What is a WCMSA?
A Workers' Compensation Medicare Set-Aside Arrangement (WCMSA) is a financial agreement that allocates a portion of a workers' compensation settlement to pay for future medical services related to the work injury that would otherwise be covered by Medicare.
CMS Review Thresholds
CMS recommends submitting a WCMSA for review when:
The claimant is a current Medicare beneficiary (or receiving/applying for SSDI) and the total settlement exceeds $25,000; or
The claimant has a reasonable expectation of Medicare enrollment within 30 months and the total settlement exceeds $250,000.
How WCMSA Funds Work
Set-aside funds must be held in a separate interest-bearing account and used exclusively for Medicare-covered, injury-related medical expenses. Medicare will not pay for covered services until the set-aside funds are exhausted.
CMS Approval
Submission to CMS for approval is voluntary but strongly recommended for cases meeting the thresholds above. An approved WCMSA provides a "safe harbor" confirming Medicare's interests have been satisfied.

Life expectancy figures are drawn from the CDC United States Life Tables, 2022 — National Vital Statistics Reports (NVSR), Vol. 74, No. 2, published January 2025. Table 1: Total Population (all races and sexes combined).
What the Table Shows
For each exact age x, the table gives ex — the expected remaining years of life at that age. This tool interpolates linearly between integer ages for precision.
Important Caveats
These figures reflect population-level averages and do not account for the claimant's individual health status, occupation, or injury severity. For catastrophic claims, consider consulting a life care planner or medical expert for a claimant-specific life expectancy opinion.
Even when a settlement falls below the CMS review threshold, federal law requires that Medicare's interests be considered in any workers' compensation settlement. Failure to do so can result in Medicare refusing to pay for future injury-related treatment until the settlement amount is exhausted.
Conditional Payments
If Medicare has made any payments for the work-related injury prior to settlement, those amounts must be reimbursed to Medicare out of the settlement proceeds. These are called conditional payments.
Under O.C.G.A. § 34-9-200, an injured employee is entitled to reimbursement for reasonable travel expenses incurred in obtaining authorized medical treatment, including mileage to and from physicians, hospitals, pharmacies, and other authorized providers.
Reimbursement Rate
The Georgia State Board of Workers' Compensation sets the mileage reimbursement rate pursuant to Board Rule 203. The rate is periodically updated by the Board. Confirm the current rate on the SBWC website before relying on any figure in this tool.
What Can Be Claimed
Reimbursable travel includes trips for medical treatment, physical therapy, diagnostic testing, prescription pick-up, and other authorized care. Non-medical trips (e.g., vocational rehabilitation) may also be reimbursable depending on authorization. Keep mileage logs with dates, destinations, and purpose.
